Thank you for selecting OnaTour to help you plan and book your travel requirements. We are a full service, fee based professional and educational enrichment travel agency dedicated to making sure you receive the highest quality travel service from us and the suppliers/vendors we work with.
ACCESS TO OUR WEBSITE AND USE OF THE SERVICES:
Access to and use of the services of ONATOUR, LLC (“ONATOUR”) our website and any third-party providers, suppliers and/or vendors is subject to you, the purchaser, and/or traveler (the “Customer”) acceptance of the terms and conditions set forth below (the “Terms and Conditions”).
PLEASE READ THE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE WEBSITE OR UTILIZING SERVICES. By accessing, using, or obtaining services either directly with ONATOUR, via the website, www.ona-tour.com, or by obtaining content, products or services in any way, the Customer agrees to be bound by the Terms and Conditions and is aware they are entering into a contractual agreement with ONATOUR. These Terms and Conditions include warranty disclaimers and liability exclusions to provide protection to ONATOUR, you acknowledge this is a fair balance for utilization of our services. No exceptions to the Terms and Conditions may be made by any ONATOUR employee, representative, or agent, unless in writing signed by an authorized officer of ONATOUR.
We acknowledge that every travel destination requires different services and we are excited and prepared to assist you in tailoring your trip to fit your individual and group needs. Our services (the “Services”) may include, but are not limited to, advising on destinations, itinerary creation, coordination of transportation, securing accommodations, tour packages, educational experiences, negotiations with service providers, assisting with retreat coordination and travel planning. Our Planning Fees are non-refundable for any reason and will vary based on the complexity of the services requested. Planning fees will be clearly disclosed prior to services being rendered.
GENERAL INFORMATION:
ONATOUR’S founder/CEO is a “Career’s on Vacation” Certified Travel Agent in good standing and is a fully accredited and licensed travel agency affiliated with Travel Quest Network, a Travel Leaders Network Associate.
BOOKING INFORMATION:
The Customer represents and warrants that the Customer is at least 18 years of age and possess the legal authority to make travel bookings with ONATOUR in accordance with and subject to the Terms and Conditions. The Customer agrees that he or she is and will be financially responsible for all travel bookings (as well as for the use of your account by others, including, without limitation, relatives or authorized representatives booking services on your behalf). You also agree that any information supplied by you, relatives or representatives, for purposes of any bookings is true and accurate in all respects. Without limitation, any speculative, false, misleading, or fraudulent reservation is prohibited. The Customer agrees that the travel services provided by ONATOUR shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act and for whoever you are financially responsible. A parent or legal guardian MUST authorize any bookings for minor children in writing and provide proof that they are legally responsible for the child.
ONATOUR acts solely as a booking agent for any travel-related goods and services that you, the Customer selects. Each of these suppliers, including, but not limited to airlines, hotels, transportation companies, cruise lines, retreat owners, independent contractors, air charters, tour operators are independent entities are not subject to the control of ONATOUR. The Customer understands the following applies to their reservations; the suppliers listed in their travel documentation are responsible for providing the travel services purchased; consent to the use of those suppliers; agree to review and abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, (1) payment of all amounts when due and (2) compliance with the supplier’s rules and restrictions. The Customer understands that any violation of any such supplier’s terms and conditions may result in cancellation of your reservation(s) or purchase(s), in your being denied access to any or all portions of your trip including but not limited to, flights, hotels, cruises, or vehicles, and your forfeiting any monies paid for such reservation(s) or purchase(s), and in ONATOUR collecting from your account or credit card on file, any costs and expenses ONATOUR incurs because of any such violation. The Customer agrees to be responsible for all charges, fees, duties, taxes, and assessments resulting from your bookings of reservation(s) or service(s) through access provided by ONATOUR.
LATE BOOKINGS:
Customers are advised to reserve early to avoid late booking fees and disappointment if they are too late to secure a booking they wanted.
CREDIT CARD AUTHORIZATION/PAYMENTS:
ONATOUR’S merchant account is with a third-party vendor, the site is PCI-DSS compliant and encrypts all payment information and allows for clients to make payments with any major credit card. By utilizing our services you agree to authorize ONATOUR to use your credit card to submit and process any payments authorized by you, the Customer. By utilizing our services you agree to accept financial liability for all payments including, but not limited to any credit card processing fees for each credit card transaction, any planning, cancellation, or additional fees that arise, and any and all payments for utilization of ONATOUR’S services, including payments to our respective suppliers and/or vendors. These payments must be received in accordance with ONATOUR’S and with each individual supplier’s terms and conditions.
Unless otherwise set forth in writing during the reservation process, final payment is due prior to departure according to each supplier’s terms and conditions, including, without limitation, the terms and conditions of any airline, hotel, cruise line, sightseeing or tour operators, vehicle rental agencies or other travel service vendors identified in your bookings. If your bookings involve foreign reservations or services, be advised that prices may be subject to fluctuations in currency exchange rates. If full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be subject to forfeiture. Note: Airlines and Travel Insurance companies generally require payment upfront.
MODIFICATIONS/CANCELLATIONS:
If you need to change any portion of your confirmed travel arrangements prior to your departure or during your trip, we will attempt to help you. All cancellation or modification requests must be made in writing to ONATOUR. As a result of the modification or cancellation, ONATOUR will charge an additional administrative fee of $25 or more, per change/per person, which will be provided to you with your travel documentation at the time of booking. In some cases, once a booking is made and paid for, modifying reservations is limited or may not be available at all. Applicable supplier’s cancellation penalties will apply and it is possible that you may no longer have a right to a refund. Please make sure you review each supplier’s terms and conditions and understand all cancellation, modification fees and penalties prior to booking your reservations! ONATOUR is not responsible for the Terms and Conditions of the suppliers. You, the Customer, authorize any cancellation fees to be charged to the credit card provided or deducted from any refunds the Customer is entitled to at the discretion of ONATOUR and/or the applicable supplier. All fee’s paid to ONATOUR are non-refundable for any reason.
TRAVEL DOCUMENT REQUIREMENTS AND RESTRICTIONS:
Each Customer is responsible for obtaining identification documents, including enhanced driver’s licenses, passports, visas, and all other documents required by applicable government regulations and suppliers’ policies and procedures. The Customer is advised to check each supplier’s website to ensure you and all members in your travel group obtain and carry the travel documentation required in connection with your reservations. The Customer is responsible for notifying ONATOUR when traveling on a passport from a country other than the United States. Should a license, passport or visa not be issued in a timely manner or valid for the timeframes you are traveling, ONATOUR shall not be responsible for losses suffered by the Customer. Please note that US rules regarding entry and exit from the country change frequently.
When you receive your travel documents, it is the responsibility of the Customer to review and verify all information. Contact ONATOUR immediately if changes or corrections are required.
When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and the U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification and that the traveler register with a U.S. embassy or consulate upon entering a foreign country. Acceptable identification can be found at http://www.tsa.gov/traveler-information/acceptable-ids. The name, date of birth, and gender that appear on the identification card must exactly match the same data that is listed on airline tickets and booking records. Be advised that some countries will not admit a traveler if their passport expires within six (6) months of the date of entry. Minors traveling without both parents, may be refused admittance unless authenticated and verified consent forms are provided to the authorities; see https://help.cbp.gov/app/answers/detail/a_id/268/kw/travel for forms. Individual situations vary from case to case so be sure to understand entry requirements, especially if you are traveling with minors. A failure to comply with these requirements may result in delays at security checkpoints causing the Customer to miss scheduled travel bookings.
Each country has different laws concerning past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, you are advised to contact that country directly for entry and exit requirements.
CHECK-INS AND RESERVATION VERIFICATIONS:
Due to enhanced security, it is strongly recommended that the Customer check in at the airport a minimum of three hours prior to the scheduled departure time for domestic flights and four hours prior to the scheduled departure time for international flights. The Customer is advised to reconfirm reservations and flight times at least 24 hours prior to the scheduled departure time for domestic flights, and 72 hours prior to the scheduled departure time for international flights. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. In certain instances, upon departure from certain countries, departure taxes must be paid, in cash.
RISKS AND SAFETY CONCERNS:
Travel to certain destinations may involve significant risks. The Customer is encouraged to be aware of current events that affect travel destinations, including any warnings or advisories issued by the U.S. Government prior to booking travel to international destinations.
BY OFFERING FOR SALE TRAVEL SERVICES TO CERTAIN DESTINATIONS, ONATOUR MAKES NO REPRESENTATIONS OR WARRANTIES THAT TRAVEL TO SUCH DESTINATIONS IS ADVISABLE, IS SAFE OR IS WITHOUT RISK. UNDER NO CONDITIONS SHALL ONATOUR BE RESPONSIBLE OR LIABLE FOR ANY COSTS, LOSSES, OR DAMAGES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.
Information on conditions in various countries and the level of risk associated with travel to international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov.
The Smart Traveler Enrollment Program (STEP) (https://step.state.gov/step/) is a free service provided by the U.S. Government to U.S. citizens who are traveling to foreign countries to enter information about their upcoming trip so that the State Department can assist if problems were to arise.
TRAVEL INSURANCE:
The purchase of travel insurance is not required to book and purchase any reservation or service offered by ONATOUR. UNLESS EXPRESSLY STATED OTHERWISE, TRAVEL INSURANCE IS NOT INCLUDED AS A PART OF YOUR BOOKINGS FOR RESERVATIONS OR SERVICES. THE CUSTOMER SHOULD CONSIDER PURCHASING A TRAVEL INSURANCE POLICY TO PROTECT YOURSELF FROM VARIOUS RISKS, INCLUDING, WITHOUT LIMITATION, SUPPLIER DEFAULTS, DELAYS, INTERRUPTIONS, MISSED CONNECTIONS, CANCELLATIONS, MEDICAL EMERGENCIES, ILLNESSES, CHANGE OF PLANS, ACCIDENTAL DEATH OR DISABILITY. There are significant costs and coverage differences under various travel insurance policies. The Customer is responsible for selecting the policy that best fits their needs. ONATOUR is not authorized to make any recommendations or to answer any questions about costs, coverages, benefits, exclusions, or conditions of any of travel insurance policy, however, we may suggest potential insurance provider(s) for your review, to guide you in this process.
HEALTH, SAFETY AND SECURITY CONCERNS:
Each Customer is responsible for having the necessary and proper immunizations and the required documentation of such immunizations on a valid vaccination certificate before travel. ONATOUR is not responsible for the Customers compliance with any health, vaccination, or documentation requirements necessary for travel. If you are concerned about taking any medications or receiving certain immunizations, check with your health practitioner before booking travel services. Check the US State Department Web site http://travel.state.gov for relevant information relating to travel to specific destinations, and the U.S. Center for Disease Control http://wwwnc.cdc.gov/travel/ relating to health issues.
For further information relating to health, security, safety issues, crime, terrorism, civil unrest, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States, visit www.tsa.gov, www.dot.gov, www.faa.gov.us, www.ustreas.gov, www.cbp.gov.
HAZARDOUS MATERIALS:
U.S. Federal Law prohibits passengers from bringing hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials, including paint, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. There are exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. INSECTICIDE NOTICE:
If allergies or other health issues are a concern, the Customer is encouraged to review the list of countries that require airlines to treat the passenger cabin with insecticides by checking the U.S. Department of Transportation’s website, http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsectionrequirements.
E-TICKETS:
E-tickets expire a year from the issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise. Please verify this information with your carrier, ONATOUR is not responsible for your loss.
AGENCY DISCLOSURE AND LIMITATIONS OF RESPONSIBILITY:
ONATOUR is acting as a booking agent for the disclosed airlines, air charters, cruise lines and ship and boat owners, hotels, bus companies, ground transportation, and other independent contractors who provide accommodations, transportation, and other services. All bookings are accepted by ONATOUR as an agent for the suppliers. Each of these suppliers is an independent entity with its own management and is not subject to the control or direction of ONATOUR. The Customer is advised that the suppliers whose names appear in travel documentation are the entities who are responsible for providing the services purchased. The Customer understands and agrees that each supplier’s terms and conditions set forth on their respective web sites, which, along with any applicable information set forth on the travel documentation, including, without limitation, tickets, itineraries, vouchers and receipts issued by them, govern the nature, rights and limitations of the services purchased.
AS AN AGENT FOR THE DISCLOSED PRINCIPAL SUPPLIERS, THE CUSTOMER AGREES THAT ONATOUR, OR ANY SUBAGENT, HEIR, AND ASSIGNS THEREOF ARE NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THE SERVICES. ONATOUR HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, IN CONNECTION WITH THE SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKED THROUGH ONATOUR, INCLUDING WITHOUT LIMITATION, LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES.
FORCE MAJEURE:
ONATOUR shall not be deemed to be in breach of any terms and conditions or otherwise be liable to the Customer, by reason of cancellations, delays in performance, or by non-performance, of any of its obligations hereunder to the extent that any such cancellation, delay or non-performance is due to any Force Majeure.
For purposes of these Terms and Conditions, “Force Majeure” means any circumstances beyond the reasonable control of ONATOUR, (including, without limitation, acts of God, explosions, pandemics, fires or accidents, war or threats of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbances, sicknesses, quarantines, government interventions, and weather conditions, including but without limitation, the presence or absence of snow, sun, rainfall volcanic eruptions, ash clouds, floods and high winds.
If ONATOUR and/or any of its travel suppliers, are affected by a Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any travel arrangement and the Customer shall be entitled to a refund or price adjustment in accordance with these terms and conditions and the terms and conditions of the various suppliers.
AUTHORIZATIONS TO USE IMAGES, VIDEO AND AUDIO RECORDINGS:
ONATOUR reserves the right to use in publications or other media, any content produced, used, given to or contracted for by ONATOUR indefinitely, including but not limited to pamphlets, brochures, invitations, newspapers, magazines, television, websites, any photograph, video, or audio recording taken at any event or during any travel activity, without the express written permission of those included in the content. Any Customer desiring not to be included in any photo taken or distributed must notify ONATOUR prior to booking services, in writing of such desire and provide a clear photograph of themselves for reference to our mailing address at: OnaTour 438 119th Avenue Martin, MI 49070.
PRIVACY POLICY:
At all times ONATOUR will treat your information in accordance with the ONATOUR Privacy Policy, which can be found at https://www.ona-tour.com.
RESERVATION OF RIGHTS: CHANGES TO THESE TERMS AND CONDITIONS:
ONATOUR reserves the right, in our sole discretion, to change the Terms and Conditions and Privacy Policy at any time. Updated versions will be posted on our website, www.ona-tour.com and shall be effective immediately upon posting. Please check frequently, especially before you use this website or utilize our services, to see if the Terms and Conditions or Privacy Policy have changed. The Customer’s use of the website or our services after any changes to the Terms and Conditions or Privacy Policy have been posted shall be deemed to be your consent to the changes.
RIGHT TO CORRECT ERRORS/OMISSIONS:
ONATOUR reserves the right to correct any errors or omissions that may come up. All land bookings are subject to availability and may change without prior notice, if this happens we reserve the right to adjust the booking or make other corrections, which may include Customer pricing.
ACCESS TO PASSWORD-PROTECTED/SECURED AREAS:
Access to and use of password-protected and/or secure areas of this website is restricted to authorized users only. Unauthorized individuals attempting to access these areas of this website may be subject to prosecution.

Limitation of Liability:
IN NO EVENT SHALL ONATOUR OR ANY SUBAGENT, HEIR, AND ASSIGNS THEREOF BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANOTHER PARTY'S PERFORMANCE OR FAILURE TO PERFORM, OR THE USE OF ANY GOODS OR SERVICES SOLD PURSUANT HERETO, WHETHER DUE TO BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE OR OTHERWISE.
Choice of Law:
These Terms and Conditions, and the rights and obligations of the parties, shall be interpreted and governed in accordance with the internal laws of the State of Michigan, without giving effect to Michigan’s conflicts of law provisions. The parties hereto agree that any legal action or proceedings with respect to the Terms and Conditions and any travel arrangements entered into with ONATOUR, shall be initiated in the State Courts of Allegan Country Michigan, or the Federal Courts with primary jurisdiction over such county, and the parties hereby agree to first seek resolution through mediation, if unsuccessful, subject themselves to and to accept the exclusive jurisdiction of such courts.
Attorneys Fees:
If any action at law or inequity is necessary to enforce the Terms and Conditions or any obligations incurred because of the Customer’s purchase of booking services, the prevailing party shall be entitled to reasonable attorney fees, costs and expenses in addition to any other relief to which such prevailing party may be entitled.
Waiver:
Should either ONATOUR or the Customer fail to exercise or enforce any provision of these Terms and Conditions, or waive any right in respect thereto, such failure or waiver shall not be construed as constituting a waiver or a continuing waiver of its rights to enforce any other provision or right.
Severability:
If any provision of the Terms and Conditions or the application thereof for any reason shall be declared invalid or unenforceable, the remainder of the Terms and Conditions shall not be affected, and each remaining provision shall be valid and enforceable.

REFERENCED HEREIN) CONSTITUTE THE ENTIRE AGREEMENT BETWEEN ONATOUR AND THE CUSTOMER WITH RESPECT TO TRAVEL BOOKINGS MADE WITH ONATOUR BY ANY MEANS ACCESSING SUCH INFORMATION, INCLUDING ITS WEB SITE, AND IT SUPERSEDES ALL PRIOR COMMUNICATIONS AND PROPOSALS, WHETHER ELECTRONIC, ORAL OR WRITTEN, BETWEEN ONATOUR AND THE CUSTOMER WITH RESPECT TO COMMUNICATIONS BETWEEN THE PARTIES, INCLUDING INFORMATION CONTAINED ON OR ACCESSED THROUGH ONATOUR’S WEB SITE OR OTHER MEANS.
